Cobb County Criminal Defense Attorney

Ben F. Smith is a Marietta native with strong ties to the Cobb County community. He has been practicing law in Cobb County for over 20 years. His father, Ben F. Smith, Sr., practiced law for over 30 years in Cobb County and was Cobb County’s Solicitor General as well as the District Attorney for the Cobb Judicial Circuit for seven years. In addition to his tenure in public office, Ben F. Smith, Sr., was a successful trial lawyer and a State Representative and served the Cobb County community for many years.

Ben is a graduate of the University of Georgia where he obtained his Bachelor of Science degree. After obtaining his Juris Doctor degree, he began practicing law in Cobb County in 1989 as an Assistant District Attorney for the Cobb County DA’s Office. As an Assistant District Attorney, Ben was assigned to the trial division where he prosecuted felony cases on behalf of the State of Georgia.

In 1992, Ben successfully ran for the position of Solicitor General of Cobb County. He was elected and took office in January of 1993. Ben won a second term in 1996 and was later appointed as the District Attorney of Cobb County by Governor Zell Miller. In 1998, Ben went into private practice, specializing in criminal defense and general litigation. In 2006, Ben joined Smith, Smith, Schnatmeier, Dettmering & Kilgo, LLP as a partner. Ben uses his years of trial experience to represent clients in the areas of DUI defense, criminal defense, and general litigation.

In addition to the Georgia Bar, Ben has been admitted to practice before the Georgia Supreme Court, the Georgia Court of Appeals, and the U.S. District Court of Georgia.

Ben lives in Marietta, Georgia, and is a member of the First United Methodist Church of Marietta.
